The Legal File

September 13, 2011

This is really tremendous.

A 290-pound New York man is suing fast food chain White Castle because he is unable to fit into the restaurant’s booths.

I like that one of the responses from White Castle was coupons for free hamburgers, making him, I assume, even less able to fit into their booths. On the other hand, it is remarkable that White Castle is agreeing to expand the size of their booths.

It is not quite as remarkable if you think of this as less a concession to this guy’s legal action and more a recognition that he is probably a morbidly obese canary in the coalmine. A sign that White Castle is, quite literally, squeezing its core constituency and they are going to have to make changes if they don’t want to drive their customers, slowly, away.

Hat tip to Alex who alerted me to this.

Is this really an ADA issue? I mean, do restaurants have to, by law, have seating that accommodates people who weigh 600 pounds? 800 pounds? What if you have an airline, little prop planes, and people over 300 pounds cannot be in the planes because the planes then can’t fly? Do you have to fly bigger planes?

Do they serve White Castles on said planes?

Would it kill this guy to stand at the counter and eat his burger? Now that I think about it, it probably would…never mind.
